1. Acceptance of Terms
By accessing or using the Calorie Tracker application (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must cease use of the Service immediately.
2. Description of Service
Calorie Tracker provides users with tools to log dietary intake, track macronutrients, and receive nutritional estimations powered by Artificial Intelligence (“AI”). The Service includes synchronization features across devices for registered users.
3. Account Registration and Login
You may use the Service anonymously or by registering through third-party authentication providers including Google and Facebook. When using third-party logins, you agree to comply with their respective terms of service. You are responsible for maintaining the security of your device and account sessions.
4. AI Analysis and Accuracy
IMPORTANT: The nutritional analysis, calorie counts, and food identifications provided by the Service are generated by AI models (such as those provided by OpenAI). These are estimates only. AI can produce incorrect, incomplete, or biased information. You should not rely solely on these estimates for medical or nutritional decisions.
5. Medical Disclaimer
Calorie Tracker is NOT a medical device or a clinical tool. The information provided is for educational and tracking purposes only. We do not provide medical advice, diagnosis, or treatment. Always seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition or diet.
6. User Content
You retain ownership of any data, photos, or voice recordings you upload. However, by using the Service, you grant us the right to process this content to provide the requested analysis and improve our Service algorithms.
7. Data Deletion
You have the right to delete your data at any time. A “Delete Account” option is available in the Settings menu, which will permanently remove your profile and all associated food logs from our active databases. Anonymous users can clear their data by resetting their browser local storage or using the “Clear Cache” options if available.
8. Limitation of Liability
The Service is provided “AS IS” and “AS AVAILABLE”. To the maximum extent permitted by law, Calorie Tracker and its developers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Service.
9. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the modified Terms of Service.
