CaloriTracker is a nutrition tracking service that helps you log food, understand patterns in what you eat, and receive AI-assisted estimates and insights based on the information you provide. This Privacy Policy explains what data we collect when you use our website, app, and related services, how we use that data, when we share it, how long we keep it, and what rights you have over it.
When we use the term “Personal Data”, we mean information that identifies you, relates to you, or can reasonably be linked to you. This includes obvious account information such as your email address, but it also includes content you submit to the service, such as meal descriptions, food photos, voice input, and activity associated with your account.
This Privacy Policy applies only to CaloriTracker and the services we operate and control. It does not apply to third-party services, websites, or providers that we do not own or manage, even where those services interact with CaloriTracker. Those third parties operate under their own terms and privacy policies.
1. Who is responsible for your data
CaloriTracker is operated by Žiga Berce. For the purposes of applicable data protection law, including the GDPR where it applies, Žiga Berce is the data controller responsible for the processing described in this Privacy Policy.
If you have questions about this Privacy Policy or want to exercise your privacy rights, you can contact us at hey@caloritracker.com.
2. The data we collect
We collect data from a small number of sources: directly from you, automatically when you use the service, and in limited cases from authentication or infrastructure providers that help us operate CaloriTracker.
The data we collect depends on how you use the service.
If you create an account, we collect your email address and basic account records such as the date your account was created and certain technical information needed to keep your account working securely.
If you log meals, we collect the content you submit, which may include typed food descriptions, meal photos, voice input, edits you make to generated results, timing information connected to those logs, and nutrition-related values created or confirmed inside the app.
If you use the website or app, we collect limited technical and usage data, such as browser type, device type, operating system, timezone, session-related information, error logs, and product interaction events that help us understand how the service is being used and where it may need improvement.
We do not collect precise location data. Timezone may be used so your entries, summaries, and daily views align correctly with your day.
3. Sensitive data and nutrition information
Because CaloriTracker is a nutrition tracking service, some of the information you provide can be sensitive in context. Meal logs, eating patterns, fasting-related inputs, and similar information may reveal information about your health, habits, or physical condition. For that reason, we treat this category of information with additional care.
We use this information to provide the service you asked for, such as estimating calories and nutrients, keeping your history, and generating insights based on your own entries. We do not sell this information, and we do not use your identifiable food logs, photos, or voice inputs to train external AI models.
4. How we collect your data
We collect Personal Data directly from you when you create an account, sign in, log meals, upload photos, use voice input, edit entries, contact support, or otherwise submit information through the website or app.
We collect certain technical and usage information automatically when you use the service. This includes the use of cookies, local storage, session technologies, and analytics tools on the website, as described further in the Cookie Policy.
We may also receive limited data from service providers that help with authentication, hosting, email delivery, analytics, and AI processing. We only use those providers to the extent necessary to run CaloriTracker and support the features you use.
5. How we use your data
We use your data primarily to operate CaloriTracker as a nutrition tracking service.
That includes creating and maintaining your account, keeping your data associated with your profile, processing your meal entries, generating estimates and insights, storing your history, showing progress and trends, and making it easier for you to log similar foods again in the future.
We also use your data to improve the reliability, usability, and safety of the service. This includes understanding which features are used, diagnosing bugs, investigating errors, monitoring abuse, maintaining system security, and improving the accuracy and quality of the product over time.
Where appropriate, we may use aggregated or de-identified data for product analysis and improvement. This means information that has been stripped of direct identifiers or combined into statistics so that it no longer reasonably identifies you. We do not use identifiable food logs, photos, or voice content for advertising, and we do not sell your Personal Data.
6. How we do not use your data
We do not sell your Personal Data.
We do not share your identifiable meal logs, food photos, or voice inputs with advertisers for ad targeting.
We do not use your identifiable content to train third-party AI models.
We do not collect more data than we need just because the tools allow it. Our approach is to collect what is necessary to run the product, improve it responsibly, and keep it secure.
7. AI features and data use
CaloriTracker uses AI services to help interpret your inputs and generate outputs such as nutritional estimates, food recognition results, and related insights. When you use features that rely on AI, the information you submit for that feature may be sent to an AI processing provider for the limited purpose of generating a result for you.
Depending on the feature, that may include typed food descriptions, meal photos, voice input, and relevant context needed to interpret the entry accurately.
The purpose of this processing is to deliver the service you requested. It is not to advertise to you, sell your data, or build unrelated marketing profiles. We work with providers under data processing terms designed to limit how they may use the data we send. Where a provider offers a setting or commitment that customer content is not used to train models by default, we rely on that setting or commitment for the CaloriTracker service.
If you choose to use your own API keys with third-party providers, the processing of data through those providers may also be governed by their own terms and privacy policies. In that case, you are responsible for reviewing those third-party terms before enabling that option.
AI processing is stateless, meaning each request is processed independently and is not tied to a persistent memory of your data. We do not use your identifiable data to train AI models, and data sent to AI providers is used only to generate results for your request.
8. Legal bases for processing
Where the GDPR applies, we rely on one or more of the following legal bases depending on the context.
We process account and service data where necessary to perform our contract with you, meaning to provide the service you signed up for.
We process certain technical, product, and security-related data where necessary for our legitimate interests, including maintaining the security and stability of the service, preventing abuse, improving product performance, and understanding how the service is used, provided those interests are not overridden by your rights and interests.
We rely on consent where consent is required, including for non-essential cookies and analytics technologies on the website, and where appropriate for the processing of nutrition-related information that may be sensitive under applicable law.
9. When we share your data
We share data only where needed to operate CaloriTracker or where we are legally required to do so.
This means we may share relevant data with service providers that help us host the product, send emails, analyze usage, authenticate users, process AI requests, store data, secure the service, or otherwise perform functions on our behalf. These providers are not allowed to use your data for unrelated purposes simply because they process it for us.
We may also disclose information where required by law, legal process, or government request, or where necessary to protect the rights, safety, and integrity of CaloriTracker, our users, or others.
If CaloriTracker is ever involved in a merger, acquisition, sale of assets, financing, reorganization, or similar business transaction, your data may be transferred as part of that transaction. If that happens, we will make reasonable efforts to notify users before the data becomes subject to materially different privacy terms.
10. Where your data is stored and processed
CaloriTracker uses infrastructure hosted in the European Union, and your database is intended to be stored in Germany. Some service providers we use may process data in other countries depending on how their services operate.
Where data is transferred outside the European Economic Area, we will rely on appropriate safeguards where required by law, such as contractual protections or another valid transfer mechanism recognized under applicable law.
We do not routinely access or review individual user data. Access is technically possible for debugging or support purposes, but we do not maintain workflows that involve actively reviewing personal user data.
11. How long we keep your data
We keep Personal Data for as long as reasonably necessary to provide the service, maintain your account, comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements.
In general, account and content data are retained while your account remains active. If you delete your account, we will delete or anonymize your data within a reasonable period, except where we need to retain limited information for legal, security, backup, fraud-prevention, or compliance reasons.
Analytics and technical logs may be kept for a shorter period based on operational need and then deleted, aggregated, or de-identified.
Some data may remain in encrypted backups for a limited period (up to 60 days) and is automatically deleted as those backups are rotated. This data is not actively used.
12. Security
We use encrypted connections (HTTPS) for data transmission and rely on infrastructure-level protections from our hosting providers, along with access controls to limit who can access systems.
No online service can guarantee complete security. For that reason, while we work to protect your information, we cannot guarantee that transmissions over the internet or stored data will always remain completely secure.
13. Your rights
Depending on where you live, and in particular where GDPR applies, you may have the right to request access to your Personal Data, correct inaccurate data, delete data, restrict certain processing, object to certain processing, and receive a portable copy of certain data you have provided to us.
You may also withdraw consent where we rely on consent. Withdrawing consent does not affect processing that took place before withdrawal, but it may affect the availability of features that depend on that consent.
To exercise your rights, contact hey@caloritracker.com. We may need to verify your identity before fulfilling certain requests. If you are in the EEA, UK, or another jurisdiction that provides this right, you may also have the right to lodge a complaint with your local data protection authority.
You can access, update, export, and delete your data directly within the app without needing to contact support.
14. Eligibility and children’s privacy
As stated in the Terms of Service, CaloriTracker is not intended for individuals under 16 years of age, and we do not knowingly collect Personal Data from users under 16. If you are under 16, please do not use the service or submit any data.
If we learn that we have collected Personal Data from a child under 13, we will delete that information as quickly as possible. If you believe this has happened, please contact us at hey@caloritracker.com
15. Changes to this Privacy Policy
We may update this Privacy Policy from time to time as the product, law, or our practices evolve. When we make material changes, we will update the “Last updated” date and may also provide additional notice where appropriate.
Your continued use of CaloriTracker after an updated Privacy Policy becomes effective means you acknowledge the updated Policy.
